What is the difference between EB-1A and EB2 NIW?
The EB-2 NIW and EB-1A visas are both employment-based green card categories, but they differ in eligibility criteria: EB-1A: Requires proof of extraordinary ability in your field, demonstrated by sustained national or international acclaim. It is the most prestigious category and also allows for self-petition. EB-2 NIW: Requires an advanced degree or exceptional ability and three-prong criteria proof that your work is in the national interest of the United States. How long does the EB process take?
This is dependent on your financial power. You have two options normal and premium processing. For normal processing decision can be between 6 months to 2 years. For premium processing (Costs an extra $2805) EB1A decision is 15 business days, EB2NIW decision - 45 business days
Is there an age limit?
No, anyone can apply whether young or very old. No age limit whatsoever.
If I get a denial can I reapply?
Yes, as many times as possible. Every case is treated separately as a new case. If your EB2 is denied, you can even apply for EB1A, each case is treated separately.
Can I apply outside America?
Yes. If you currently reside in Africa, Australia, Europe etc you can apply, when you get the I140 approval, you will begin consular processing to get your green card.
